Did you know this about real estate agents?
1. Kick backs are rampant with real estate agents, brokers and title companies. This is unreported income, which makes the standard six percent commission more like eight or nine percent. Go the the NAPHB.COM "Buyer Resources" and read the Government Account Office report on kick backs in the real estate industry.
2. Standardized Realtor Contracts contain the language “not responsible for the performance of this contract.” In other words, the agents do not have to do anything.
3. Standardized Realtor Contracts do not state anywhere in them that the agents are responsible for selling the property. Why are they getting the commission if they are not selling anything?
4. The standard Realtor’s Purchase Contracts, used by millions of people from coast to coast, indemnify the agents and the brokers from fraud and has you agree to pay for attorney’s fees if you do not prevail in any action.
5. In addition to being indemnified from fraud, the brokers and the agents are actually parties to your contract. In other words they have an equity claim in the form of commissions in your property. According to NAR, this is not unethical.
6. Agents and brokers receive absolutely no training on how to evaluate property. Why are they the ones who tell everyone the price of their house?
7. As a buyer, you never see the listing agreement with the sellers. It states that the agents are only responsible for finding a “willing, able buyer.” It doesn’t state that they are selling anything. Additionally, the fact that it is never revealed, yet they all want you to agree to it, should tell you something about the ethics.
8. Thousands of complaints get filed at Real Estate Commissions every year in all fifty states, yet only one or two agents ever gets disciplined. Where is the enforcement?
9. All Multiple List Systems involve tacit collusion where agents and brokers act as a cartel against consumers. Go to the NAPHB.COM "Buyers Resources" and read the American Federation of Consumers report on the real estate cartel.
10. Appraiser are routinely subject to all kinds of pressure to appraise a property to a value the agents want. In other words they do what the agents tell them or they never get called for work again.
11. The listing agreement with the seller states that the seller will pay the six percent commission. However, this is not true. The buyer is the one who pays. It is the buyer’s actions that result in money being advance to the settlement and that money is in their name, not the seller’s name. What takes place is actually a matter of selective accounting. The money which was in the buyers’ name gets put onto the settlement sheet in the sellers’ name and then given to the brokers. The listing agreement is with the seller, and they are the party identified as the payer of the commission only because the transfer of the buyers’ money is on their side of the HUD1 settlement sheet at the time, but the buyer actually pays. The commissions are figured into the mortgage and consideration the buyer pays.
12. Agents receive monetary incentives like exotic vacations to steer consumer to affiliated title companies.
13. It is a conflict of interest for anyone to offer an “opinion of value” and to attempt to solicit a listing agreement.
14. A Comparative Market Analysis is really an appraisal even though agents tell people it is not an appraisal.
15. The same group of people who sold you your house and told you its value would continue to soar will not return to your front door and help you make payments when the value goes down.
16. Realtors can be convicted of civil or criminal fraud and still be realtors.
